Welcome to Dhad. By using our services, you agree to the following terms and conditions. Please read them carefully before using the platform.
1. Service Definition
Dhad is a Kuwaiti platform offering customer service and sales automation via WhatsApp and Instagram using AI. Services include: AI auto-reply bot, conversation management, lead generation, and analytics reports.
2. Subscription Terms
- Subscribers must be a registered business or commercial entity
- Subscribers must have a WhatsApp Business API account or Instagram Professional account
- Subscribers are responsible for the accuracy of information provided upon registration
- Subscriptions are personal and non-transferable to third parties
3. Plans & Pricing
- Growth: 90 KD setup + 40 KD/month (1,000 messages/month)
- Pro: 150 KD setup + 70 KD/month (3,000 messages/month)
- Custom: By agreement
15% discount for annual subscriptions. Additional fees apply when exceeding the monthly message limit.
4. Payment & Billing
- Setup fees are paid once at service start and are non-refundable
- Monthly subscriptions are paid in advance at the start of each billing cycle
- Late payment may result in temporary service suspension
- All prices are in Kuwaiti Dinar (KD) and include applicable taxes
5. Acceptable Use
Subscribers agree not to use the service for:
- Sending spam or unsolicited messages
- Contacting users who have not consented to receive messages
- Publishing misleading or illegal content under Kuwaiti law
- Violating Meta's policies for WhatsApp and Instagram
- Any fraudulent or unlawful activity
6. Modifications & Customization
- Subscribers may request 2 free modifications to bot settings per month
- Additional modifications are subject to fees agreed upon in advance
- Updating basic information (pricing, working hours) is free
- Changing the bot's persona or adding new services counts as a paid modification
7. Service Level
- We target 99% system uptime per month
- Scheduled maintenance is communicated to clients in advance
- Technical support is available via WhatsApp during business hours (9AM–6PM)
- Dhad is not responsible for outages caused by Meta or third-party service providers
8. Intellectual Property
All platform content including code, designs, and algorithms are the exclusive property of Dhad. Subscribers retain ownership of their data and conversation content.
9. Service Termination
- Subscribers may terminate their subscription with 30 days prior notice
- Dhad reserves the right to terminate service immediately in case of terms violation
- Upon termination, subscriber data is delivered and deleted from our systems within 30 days
- Pre-paid subscription fees are non-refundable
10. Limitation of Liability
Dhad is not responsible for any indirect damages or loss of profits resulting from the use or inability to use the service. Dhad's maximum liability shall not exceed one month's subscription value.
11. Meta Policy
The service relies on WhatsApp and Instagram platforms owned by Meta. Subscribers are required to comply with Meta's business policies. Any changes to Meta's policies may affect the service provided.
12. Governing Law
These terms are governed by the laws of the State of Kuwait. Any disputes shall be resolved through legal procedures applicable in Kuwait.
13. Terms Updates
Dhad reserves the right to modify these terms at any time. Subscribers will be notified of material changes 14 days before they take effect. Continued use of the service after any modification means acceptance of the updated terms.
